GOODY “STYLING THERAPY” SWEEPSTAKES (the “Sweepstakes”)
OFFICIAL RULES
1. NO PURCHASE
OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL
NOT IMPROVE YOUR CHANCE OF WINNING. THE FOLLOWING SWEEPSTAKES IS OPEN ONLY TO INDIVIDUALS 18 YEARS OF AGE OR OLDER, WHO ARE LEGAL RESIDENTS OF THE 50 UNITED STATES, DISTRICT
OF COLUMBIA (“D.C.”) OR CANADA (EXCLUDING RESIDENTS OF QUEBEC).
VOID IN QUEBEC, PUERTO RICO, U.S. VIRGIN ISLANDS, U.S. TERRITORIES AND POSSESSIONS
AND WHERE PROHIBITED OR RESTRICTED BY LAW.
2. HOW TO ENTER: Sweepstakes begins at 12:00:01 a.m. Eastern Daylight Time (“EDT”) on June 11, 2007 and ends at 11:59:59 p.m. Eastern Standard
Time (“EST”) on December 31, 2007 (the “Sweepstakes
Period”). To enter, visit the Goody Products, Inc. (“Goody” or “Sponsor”) internet
website at
http://www.goody.com during the Sweepstakes Period, complete the
Sweepstakes entry
form with all required information and submit as instructed on-screen.
Entries must be received by 11:59:59 p.m. EST on December 31, 2007.
Proof of submission is not proof of receipt by Sponsor.
Any automated computer receipt (such as one confirming delivery of email)
does not constitute proof of actual receipt by Sponsor.
You may also enter the Sweepstakes at various Sponsor events occurring during
the Sweepstakes Period (to be determined in Sponsor’s sole discretion) by completing
an official entry form and depositing it in the official drop box located at said
event(s).
Limit one (1) entry per person per day, and limit one (1) entry per email address
per day, regardless of entry method.
If more than
one entry is received from the same person or from the same email address
on any given day, all entries from said person or email address received on that
day will be disqualified. Once submitted, entries become the exclusive
property of the Sponsor and will not be returned. In the event of a dispute, eligible electronic entries will be considered
made by authorized account holder of the e-mail address submitted at the time of
entry.
“Authorized account holder”
is defined as the natural person who is assigned the email address by an internet
service provider, online service provider, or other organization responsible for
assigning email addresses for the domain associated with the email address in question.
Automated entries (including but not limited to entries
submitted using any robotic, script, macro, mechanical, programmed or other automated service) and any illegible, unintelligible, incomplete, or garbled entries are
not permitted and will be disqualified. Any entries not in conformance with
these Official Rules will be disqualified.
4. DRAWING/ODDS OF WINNING PRIZE:
Sponsor will select one potential winner in random drawing
from among all eligible entries received on or about 1/2/08.
Odds of winning depend on the number of eligible entries received from all
entry methods. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in
all respects. Sponsor will attempt to notify the potential winner
by e-mail, phone or postal mail within ten (10) days of the drawing date. The potential winner (or her parent/legal guardian
if she is considered a minor in her state, province or territory of residence)
will be required to sign and return an Affidavit of Eligibility, Liability Release
and Publicity
Release (where legal) within 14 days of date on notification in order to receive the prize, or prize will be forfeited.
Potential Canadian winner (or her parent/legal guardian if she is considered
a minor in her province or territory) will also
be required to correctly answer, unaided, a time-limited, mathematical skill-testing
question prior to being declared a winner. If a potential winner cannot be contacted, if she (or her parent/legal guardian if
she is considered a minor in her state, province or territory of residence)
fails to return required documentation within the time frame specified, if prize
or prize notification is returned as undeliverable, or in the event of non-compliance
with any of the requirements herein, her entry will be disqualified, she
will not receive any prize, and the prize will be awarded to an alternate entrant
selected in a random drawing from the remaining eligible entries. Unclaimed prizes may not be awarded.
5. PRIZE:
One (1) Grand Prize will be awarded consisting of a seven day/six night Carnival
Cruise for winner and one guest. Cruise
route is winner’s choice (based on availability) from a U.S. point of departure
(with return to same location), and shall include ocean view accommodations, one
double occupancy room, and roundtrip coach airfare for two from major airport nearest
winner’s home to major airport nearest cruise departure location.
Winner will also receive a $100 American Express voucher to apply toward transportation
costs to and from the airport and $1000 (awarded in the form of a check) to apply
toward spa/salon services on board the cruise and/or for off-shore excursions during
the cruise. Winner is responsible for government fees/taxes, meals, tips, gratuities,
alcohol and all other expenses not specified herein.
Sponsor reserves the right to structure travel destinations,
routes, and hotel selection at its sole discretion.
Winner and travel companion must travel on same itinerary.
Trip must be completed within one year of the date on potential winner’s
initial prize notification. Exact travel
dates and arrangement are subject to availability.
If Grand Prize winner is unable to travel by designated date, Grand Prize
will be forfeited and may be awarded to an alternate winner.
Approximate Retail Value (“ARV”) of Grand Prize: U.S. $10,000. Actual value may vary
based on point of departure and/or airfare fluctuations and any difference
between the stated approximate value and actual value of prize will not be awarded.
If Grand Prize
winner is considered a minor in her state, province or territory of residence, the
Grand Prize will be awarded to her parent or legal guardian on minor's behalf (once
required documentation is received within the specified time frame), and the parent
or legal guardian must accompany the winning minor on the trip.
Grand Prize winner's travel companion may not be a minor unless Grand Prize
winner is the parent or legal guardian of the travel companion.
Grand Prize winner’s travel companion must sign and return a liability/publicity
release within time frame specified by Sponsor.
If travel companion is an eligible minor, in accordance with these Official
Rules, then Grand Prize winner must execute such documents on companion’s behalf. If Grand Prize winner or her travel
companion is an eligible minor in accordance with these rules, s/he may not be able
to participate in all onboard activities and excursions, which are subject to Carnival
Cruise rules and regulations, and applicable law.
By accepting prize, Grand Prize winner (or her parent or legal guardian) acknowledges
the inherently dangerous nature of and risks in travel and cruising, including but
not limited to personal injury and or death, and agrees to accept sole responsibility
for such risks.
Trip prize (or any portion thereof) may not be sold, traded, transferred, assigned,
refunded, or redeemed for cash and cannot be rescheduled once booked.
All taxes or expenses,
including, without limitation, sales tax, luxury tax and any other costs incurred
in claiming or using any of the prizes, are the sole responsibility of the Grand Prize winner.
No prize substitution or cash
equivalent of prize will be granted, except at Sponsor’s
sole discretion. If prize becomes unavailable, Sponsor reserves the right to award a prize
of equal or greater value.
6. GENERAL:
Sweepstakes is subject to all applicable federal, state,
provincial and local laws.
By entering and/or accepting a prize, each entrant and/or winner (a) agrees to release
Sponsor, and its parent company, affiliates, subsidiaries, divisions, advertising
and promotion agencies, and all of their respective
employees, directors, officers, shareholders, agents, attorneys, successors or assigns (collectively “Releasees”), from any and all liability, loss or damage of any kind incurred with respect to
participation in this Sweepstakes, the awarding, receipt, possession, and/or use
or misuse of any prize, or participation in prize-related activities (including
but not limited to travel related thereto); and (b) consents to the use of his/her name, likeness, quotes and/or identity for advertising and publicity purposes by
Releasees, with no additional compensation, as permitted by law.
Releasees are not responsible for and are hereby released from liability
with respect to: (i) electronic transmissions/entries that are lost, late, stolen, incomplete, illegible, damaged, garbled,
destroyed, misdirected, or not received
by the Sponsor
or its agents for any reason, (ii) any problems or technical malfunctions, errors,
omissions, interruptions, deletions, defects, delays in operation or transmission,
communication failures or human error that may occur in the transmission, receipt
or processing of entries, or for destruction of or unauthorized access to, or
alteration of, entries, (iii) failed or unavailable
hardware, network, software or telephone, cable or satellite transmissions, damage
to entrants’ or any person’s computer and/or its contents, or causes
beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity
or proper conduct of this Sweepstakes or
(iv) any entries submitted in a manner that is not expressly allowed under these Official Rules. All incomplete or non-conforming
entries will be disqualified. Releasees are further not responsible
for and are hereby released from liability with respect to incorrect or inaccurate entry information whether
caused by Internet users or by any of the equipment or programming associated with or utilized
in the Sweepstakes or by any technical or human error which may occur in the transmission,
receipt or processing of the entries. If for any reason this Sweepstakes is
not capable of running as planned, or if this Sweepstakes or any Web site associated
therewith (or any portion thereof) becomes corrupted or does not allow the proper
playing of the Sweepstakes and processing of entries per these Official
Rules, or if infection by computer virus,
bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any
other causes, in Sponsor’s sole opinion, corrupt or affect the administration, security,
fairness, integrity, or proper conduct of this Sweepstakes,
Sponsor reserves the right, at its sole discretion, to
disqualify any individual implicated in such action,
and/or to cancel, terminate, modify or suspend this Sweepstakes.
In the event this Sweepstakes is cancelled, Sponsor reserves the right to
conduct a random drawing to award the prizes from among all eligible, non-suspect,
entries received prior to the time of the action or event warranting such cancellation.
7. WARNING:
ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE
OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL
AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT
BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE
FULLEST EXTENT PERMITTED BY LAW.
8. PRIVACY: The personal
information collected from each entrant in the course of the
Sweepstakes will be used by the Sponsor for the purposes of administration of the
Sweepstakes and as otherwise permitted in accordance with Sponsor’s Privacy Policy.

9. WINNERS LIST AND OFFICIAL RULES: For a copy of these Official Rules, visit
www.goody.com during the Sweepstakes Period. Winner’s names and addresses (city and state/province
only) may be posted online following winner verification at the conclusion of the
Sweepstakes. To receive the
